How to read these conditions
These Terms and Conditions apply once you and Pelorix Travel Club have agreed on a journey in writing. They cover the three things we sell: the Cruise Planning Conversation, the Gentle-Pace Day Excursions and the Restful Stay Arrangement. The website itself is covered by the Terms of Service, and the prices, payment and cancellation figures are set out in the Commercial Transactions Notice. If something in your written confirmation is different from this page, the confirmation wins, because it was written for your journey.
1. What each service is, and what it is not
- Cruise Planning Conversation: about sixty minutes in Kanazawa or by video, a written summary of two or three sailings, a packing and documents checklist, and a follow-up call a week later. It is a consultation. We do not sell cruise tickets, and booking a cruise through the club is never required.
- Gentle-Pace Day Excursion: a small-group day out that starts and ends at Kanazawa Station, with a reserved coach, a guide who speaks English, entrance fees and a seasonal set lunch as listed in the Companion Notes, and a club host with the group.
- Restful Stay Arrangement: we choose the venue with you, make the reservation, book trains or transfers, and give you a printed day-by-day plan in large type and a number to call during the stay. Our fee covers this work only. Lodging, meals beyond those quoted, and transport are quoted separately and are paid for the service of the venue or operator concerned.
2. Travel agency registration
Arranging transport and lodging for a fee can fall under Japan's Travel Agency Act. Where an activity we offer needs registration under that Act, the club either holds the registration or arranges the activity through a registered travel agency. In both cases the registration category, number and registering authority are written in the confirmation we send before you pay, and we will read them out on the phone whenever you ask. The Cruise Planning Conversation is advice, not a travel contract, and the venue, ship line or transport operator remains the party that provides its own service.
3. How a contract is made
- You ask, we describe, and nothing is binding yet.
- We send a written confirmation that lists the service, date, meeting point, price, what is included and what is not, the cancellation terms and the registration details from section 2.
- The contract begins when you have said yes to that confirmation, by email or in writing, and the payment arrangement stated in it is followed.
4. Price and payment
Prices are in Japanese yen. The current figures are shown on the Our Journeys page: 4,400 yen per consultation, 11,000 yen per person for a day excursion and 16,500 yen per stay arrangement. The confirmation shows the amount you will pay, including consumption tax. Payment is made by the method and on the date written in the confirmation. We will not ask you to pay by an unusual route, and we will never ask for card details by an ordinary email.
5. Changing or cancelling
- You may cancel or change a booking by phone or email. The cancellation charge, if any, is the one printed in your confirmation, and it is explained to you before you agree.
- A cruise conversation can be moved to another day at no charge when you tell us in good time.
- If the club has to cancel or change a day excursion, for example because of a weather warning, a road closure or too few guests, we will tell you as early as we can and offer you another date or a refund of the amount paid for that excursion.
- For a stay, the cancellation rules of the venue and of any transport you have booked also apply, and we tell you what they are before you confirm.
6. What we ask of you
- Tell us honestly about your health and mobility where it affects the plan, so that we can pick the right Pace Marker. If we think a journey is not suitable, we will say so and suggest another.
- Bring any medication you use, and keep it with you. Our hosts cannot give medicine or medical treatment.
- Arrive at the meeting point on time, and follow the reasonable instructions of the guide and host, especially near roads, water and steps.
- Treat other guests, drivers and venue staff with respect. We may stop a guest from continuing if their behavior endangers others.
7. Health, safety and what we cannot promise
Pelorix Travel Club is not a medical, nursing or care provider and gives no medical advice. A Pace Marker describes the walking we plan; it is not a statement that a route is safe for any particular person. We take sensible care in choosing routes, rest stops and venues, but we cannot promise that no accident, illness or delay will occur, and any health program at a hot-spring or resort venue is provided by that venue's own qualified staff under its own conditions. We recommend that you carry travel or accident insurance that suits you.
8. Our responsibility
We are responsible for carrying out the arrangements we promised with reasonable skill and care. We are not responsible for loss caused by events outside our control, for the acts of independent venues and operators when they act on their own account, or for loss that could not reasonably have been foreseen. Nothing here limits liability that cannot lawfully be limited, including liability for intentional or grossly negligent acts, or your rights as a consumer.
9. Complaints
If something went wrong, please tell your host on the day, or write to info@pelorix-travel-club.com within a month. We will look at it with the club's management and answer in writing.
10. Law and courts
Japanese law applies. If a dispute cannot be settled by talking, the Kanazawa District Court is the court of first instance with non-exclusive jurisdiction, without limiting any mandatory consumer right you may have to sue in the court of your own address.
